2. Payment Terms and Agreement
2.1 You are agreeing to pay for your order in accordance with the payment terms of design58. These require a 25% deposit with order and 75% payment on delivery or completion of works. A project is considered completed if design58 is waiting for content from you that is preventing completion of the project.
2.2 Where payment is not made, all online services will be suspended until payment is made in full.
2.3 design58 accept payment by the means of cash, cheque, bank transfer and BACS payments.
2.4 An additional charge will be applicable should you request changes to the design that are substantially different to your original request after design58 has supplied the design proof.

3. Copyright
3.1 All goods provided or delivered as a result of an order will remain the property of design58 until payment is received and cleared in full.
3.2 design58 retain the copyright on all designs produced.
3.3 For any images that you supply to design58, you must have full permission of the copyright holder; this insures design58 against any future copyright claims.
3.4 All intellectual property rights existing in the artwork, designs, underlying source code and all other material on this website are copyright of design58, and its affiliates or their content and technology providers and will remain the property of design58 and M.A.Longbottom. Any infringement of these rights will be pursued vigorously.
3.5 All Rights Reserved. Permission is granted to electronically copy, and to print in hard copy, portions of www.design58.com for personal and reference use only. Any other use of materials on www.design58.com including reproduction for purposes other than those noted above, modification, distribution, or republication without the prior written permission of design58 is strictly prohibited.

4. Guarantee and Refund of Deposit
4.1 design58 provide a design service based on the clients needs. With an initial free consultation providing a quote for the work to be done, then development of initial designs giving you a choice of up to four possibilities. If you are not happy with these designs, further consultation to provide appropriate feedback to help the design process to progress will be initiated. If you are not happy with the service you can request that your deposit payment be refunded.
4.2 Your deposit becomes non-refundable once both parties have made agreement over a specific design.

5. Proofs
5.1 All proofs linked to print design will be provided by e-mail as either a JPEG or PDF files – printed proofs can be sent on request.
5.2 No work will be printed or published until your confirmation and agreement to the proof document is received.

6. General
6.1 where printed material is involved we will liase with you and any third party suppliers for a satisfactory outcome.
6.2 Prices on www.design58.com are subject to change without notification.
6.3 Time and price quotations are subject to change unless quoted in writing and then are subject to a maximum guarantee of 2 months from the date written.
6.4 Four page websites provided by design58 are offered on a hosting inclusive basis for the first 12 months. You will then be invoiced annually for the hosting of your website for a previously agreed figure. Pricing of hosting linked to larger websites will be discussed during the consultation process
6.5 Website and e-mail hosting services provided by design58 are not offered with guarantees or assurances of service delivery or performance. However, design58 and their professional service providers make all reasonable efforts to ensure continual professional services are provided.
